Many foreigners assume that investing in Colombia is the fastest path to a visa. However, the M Visa for Business Partners or Owners, regulated under Article 75 of Resolution 5477 of 2022 (official source, in Spanish), is one of the most technical categories, and one of the most closely reviewed by Cancillería. Simply opening a company or putting money into an account is not enough: if the investment is not properly registered, or if the company exists only on paper, the application can end up inadmitted or denied without a clear explanation.

Common mistakes that sink the application
  1. Investing without proper legal advice and failing to register the capital contributions with the Banco de la República.

  2. Presenting shell companies that generate no jobs or income.

  3. Omitting the accountant's signature on the financial statements.

  4. Assuming that any amount is sufficient: Cancillería requires specific thresholds tied to Colombia's monthly minimum legal wage (SMMLV).


Strategy to protect the visa
  • Build a real business plan, with income projections and job creation.

  • Register the foreign investment with the Banco de la República from the very start of the process.

  • Work with a certified public accountant in Colombia who can back up the financial information, and stay current with tax obligations before the DIAN (official source, in Spanish).
